West Branch man charged with 3rd OWI

Authorities have accused a West Branch man of driving while intoxicated.

Boone Barton, 34, was charged Sept. 22 with third-offense OWI.

According to online documents, Barton was seen at an RJZ Express in Solon. Staff members called Johnson County to report an intoxicated driver in a blue pick-up truck with a dark topper.

The officer located the truck in the area of Highway 1 and Interstate 80. The officer reported that Barton’s vehicle was all over the road.

After Barton pulled over, the officer reported he spied a 25-ounce can of Busch Light in Barton’s lap.
According to the report, he smelled of alcohol and was visibly intoxicated. He was unable to successfully follow instructions or demonstrate fine motor skills, the document said.

After being read his Miranda rights, Barton admitted to drinking and also blew a .225. Once Barton arrived at the police station, he refused to take the Datamaster test.

Barton received two OWIs in 2007 and one in 2009.

Third-offense OWI is a Class-D felony.
