Two brothers arrested for assaulting officer

Iowa City police arrested two University of Iowa students who are brothers Sunday after they allegedly assaulted a police officer.

Mitchell Hruby, 19 and Bret Hruby Jr., 21, 417 S. Gilbert St. Apt. 2322, were charged Sunday with assault on a peace officer.

According to the report, an officer was called to their apartment after receving a report of loud music and loud voices. The officer told Mitchell Hruby he would be cited with keeping a disorderly house and asked where the smell of marijuana was coming from. Hruby told the officer it was an incense candle and said the officer needed a warrant to search his apartment.

According to police, the officer said he could lock the apartment down while waiting for a warrant and moved into the doorway, at which point Mitchell Hruby allegedly lunged forward and pushed him.

The officer handcuffed Mitchell Hruby and locked the apartment down for a search warrant.

While officers were conducting the search, Bret Hruby allegedly kicked an officer who was on the floor attempting to control his brother.

Bret Hruby later told officers that he shouldn’t have kicked the officer but said he always “has his brother’s back.”

Assault on a peace officer is a serious misdemeanor, punishable by a maximum of one year in jail and a fine of up to $1,875.
